(5.) wenn der Aussteller den Zahlungsauftrag widerrufen -
hat;
(d.) bezüglich des Indossanten in folgenden Fällen,
nämlich:
(1.) wenn der Bezogene eine erdichtete oder nicht
vertragsfähige Person ist und der Indossant von
diesem Umstande zur Zeit seiner Indossirung

(2.) wenn der Indossant derjenige ist, welchem der
Wechsel zur Zahlung präsentirt wird,
(3.) wenn der Wechsel aus Gefälligkeit für denselben ¬

to be liable without notice, the drawer must have had no
remedy against the acceptor or any other person. Hence,
if a bill be drawn for the accomodation, not of the drawer,
but of the acceptor, as the drawer might sue the acceptor
he is entitled to notice." — S. 245. „When there are no
effects of the drawer in the hands of the drawee at the
time when the bill is drawn, the drawer must know, that
he is drawing on accommodation; but, if he have effects
at the time, it would be very dangerous and inconvenient.
merely on account of the shifting of a balance, to hold
notice not to be necessary. It would be introducing a
number of collateral issues in every case upon a bill of
exchange, to examine how the account stood between the
drawer and the drawee, from the time the bill was drawn
down to the time it was dishonoured.“ — Chitty S. 346.
Es ist aber angenommen worden, daß der Aussteller dann eine
Benachrichtigung verlangen darf, wenn er triftige Gründe zu der Erwartung ¬
hat, daß der Wechsel acceptirt werden würde. — Byles
S. 246. „And, in general, though the drawer had no effects
in the hands of the drawee, yet if he had any reasonable
expectation that the bill would be honoured, he is entitled
to notice of dishonour, as if he have consigned goods to
the drawee, though, in fact, they never came to hand, or
have accepted bills for him.

Hingegen nicht, wenn der Wechsel bezüglich des Ausstellers
ein Gefälligkeitswechsel war. — Byles S. 244. „It is no excuse
for neglect of notice to an indorser, that the drawer
had no effects in the acceptor's hands. „That circum-
