103. LIBER DECIMVS.

NObili Græcorum & ampla ciui
tate Epheſi lex uetuſta dicitur à
maioribus dur a conditione, ſed
iure eſſenon iniquo conſtituta,
Nam Architectus cum publicũ
opus cur ādumrecip it, pollicetur
quãto ſumptu id ſit futurũ. Tra
dita æſtimatione magiſtratui bona eius obligantur,
donec opus ſit perfectũ, Eo autem abſoluto cum ad di
ctum impenſa reſpõdet, decretis & honoribus orna
tur, Item ſinon amplius ꝗ̃ quarta in opere cōſumitur
ad æſtimationem eſt adiicienda, & de publico præſta
tur, neq́ ulla poena tenetur, Cũ uero amplius ꝗ̃ quar
ta in opere conſumitur, ex eius bonis ad per ficiendũ
pecunia exigitur, Vtină Dii imortales feciſſent, ꝙ ea
lex etiam populo Romano, non modo publicis, ſed ẽt
priuatis ædiſiciis eſſet cōſtituta, nāq́ non ſine poena
graſſarentur imperiti, ſedqui ſumma doctrinarum
ſubtilitate eſſent prudentes, ſine dubitatione pro fite
rentur architecturam, neq́ patres familiarum indu-
cerentur ad in finitas ſumptuũ ꝑ fuſiones, & ut ex bo
nis eiicerentur, ipſiq́ architecti poenæ timore coacti
diligentius modũ impenſarum ratiocinantes explica
rent, uti patres familiarũ ad id, qđ præpar auiſſent,
ſeu paulo amplius adiicientes, ædificia expedirent,
